HOST A RIDE-OUT APPLICATION TERMS & CONDITIONS

 

 

1. Terms and Interpretation

1.1. In these terms and conditions, references to we, us, our or Triumph Motorcycles means Triumph Motorcycles Limited of Ashby Road, Measham, Swadlincote, Derbyshire, DE12 7JP (Registered company number: 01735844) . References to you or your means the person or entity applying to be a Host. References to a party shall mean either you or us and parties shall mean both you and us together.  

1.2. The following capitalised terms shall have the meaning first defined in this document, including:

  • Host means a person or entity that has applied to host a Ride-Out and whose application has been agreed by us;
  • Ride-Out means a Triumph 120 Anniversary Ride-Out as more particularly described on the Triumph 120 Anniversary Ride-Out website page.   

 

2. The application

2.1. You may only submit an application to host an anniversary ride in the UK or Ireland.  

2.2. If you do not supply a valid telephone number and email address with your application your application to be a Host will be invalid.

2.3. There will be a minimum of 120 Ride-Outs approved across the UK and Ireland. Not all applications will be successful. Submitting a request does not guarantee your right to Host a Ride-Out. If you are successful, we will contact you by email with a Host’s pack. All decisions as to the success of your application are at our absolute discretion.  

2.4. By applying to be a Host you agree to these terms and conditions.

 

3. Host obligations

3.1. All Hosts must:

3.1.1. not do or allow anything to be done that would, or would be likely to, bring Triumph Motorcycles into disrepute or adversely affect its reputation in any way;

3.1.2. provide every person that joins their Ride-Out with a copy of the Ride-Out Rules (see schedule 1 to these terms) and ensure compliance with them.   

 

4. Liability & Insurance

4.1. The Host acknowledges that it is responsible for the safe operation of any Ride-Out that it hosts and shall comply with any reasonable guidance provided by Triumph Motorcycles.

4.2. The Host shall take out and maintain suitable insurance to meet its obligations under these terms, to include public liability and event insurance.  The Host shall provide evidence of such insurance to Triumph on request.

 

5. Personal Data

5.1. It is agreed that each party shall be deemed a separate data controller and shall comply with all applicable laws including all laws concerning the protection of personal data.

5.2. You acknowledge that your personal information or any information of any other person that you supply to us will be stored in accordance with our privacy policy.

5.3 Before providing us with photos or any other personal data of any person you agree to obtain their consent as required under our User Generated Content Terms and notify them of our privacy policy.

6. Rights licence

6.1. Triumph shall supply the Host with certain marketing materials in connection with the Ride-Out (referred to as the ‘Ride Out Materials’).

6.2. The Host may use the Ride Out Materials only in connection with the Ride-Out and strictly in compliance with any instructions provided by Triumph from time to time.

6.3. It is acknowledged that all intellectual property rights in any Ride Out Materials shall remain exclusively owned by Triumph.

6.4. Any content that you upload to our websites or social media platforms or by tagging any content to any of our social media sites (referred to as ‘UGC’ or ‘User Generated Content’) you agree to our User Generated Content terms.

 

7. Loan motorcycles

7.1. If Triumph loans any motorcycle to you, it shall be subject to the terms and conditions of a motorcycle loan agreement.

 

8. Termination

8.1. It is agreed that we may terminate your participation as a Host at any-time.  Upon our termination you shall immediately cease any use of the Ride Out Materials and cease any representation that you have any connection with us.

 

9. Consideration

9.1. Triumph Motorcycles is not committed to contribute financially or provide any additional support, other than the provision of the Ride Out Materials and anything that is specifically agreed by us in writing. 

 

10. Law

10.1. These terms and any issues, disputes or claims arising out of or in connection with them shall be governed by, and construed in accordance with, the laws of England and Wales.

10.2. The courts of England and Wales shall have jurisdiction in respect of any such issues, disputes and claims.

Schedule 1 – Ride-Out Rules

1. The following capitalised terms shall have the meaning first defined in this document, including:

  • Host means a person or entity that has applied to host a Ride-Out and whose application has been agreed by us;
  • Ride-Out means a Triumph 120 Anniversary Ride-Out as more particularly described on the Triumph 120 Anniversary Ride-Out website page.

 

2. All riders must:

2.1. be mentally and physically fit to take part in the Ride-Out; and

2.2. have held a full UK motorcycle licence for a minimum of 12 months; and

2.3. have no unspent driving disqualifications; and

2.4. have no more than 6 penalty points on their licence; and

2.5. have not been involved in more than one accident during the preceding 3 years; and

2.6. not be under the influence of alcohol or drugs.

 

3. Motorcycle Licence. All riders must bring and hand-over their driving licence, which will be retained by the Host during the Ride-Out.

 

4. Protection. All riders must wear appropriate protective clothing when taking part in the Ride-Out. As a minimum the following is required: helmet; gloves; long sleeved jacket; trousers; boots that cover the ankle.

 

5. All motorcycles at the time of the Ride-Out must be in safe working order, have a current MOT certificate and be taxed. 

 

6. All riders must be insured to ride their motorcycles on a full comprehensive basis for the Ride-Out.

 

7. All riders must bring documentation (to prove compliance with clauses 5 and 6 above) with them to the Ride-Out and provide the same to the Host on request.

 

8. Riding Safely. All riders acknowledge that riding motorcycles is an inherently risky activity and that they are competent to ride the bike being used. If, at any stage, a rider feels unable to ride the motorcycle with confidence in a safe manner or if Triumph (or any representative of Triumph) or a Host requests a rider to stop, the rider agrees to immediately stop taking part in the Ride-Out. 

 

9. During the Ride-Out, all riders agree to:

  • follow the Host’s instructions at all times;
  • not deviate from the route set by the Host;
  • obey all speed limits and the highway code
  • not overtake anyone else who is part of the Ride-Out, unless required to do so for safety reasons.

 

10. Any behaviour that is deemed to be unsafe by the Host or Triumph (or any representative of Triumph) may lead to the Ride-Out being stopped immediately.
